Choosing an Executor: What to Know

Selecting an executor is one of the most important decisions in any will. Your executor (sometimes called a “personal representative”) is responsible for gathering assets, paying valid debts and taxes, and distributing what remains according to your instructions. Because the role can last months—or even more than a year—choose for reliability over flattery.

Start with temperament. An executor doesn’t need to be a financial wizard, but they must be organized, responsive, and calm under pressure. Family dynamics matter: appointing two siblings “to be fair” can backfire if they disagree about every decision. A single primary executor with a named backup is usually cleaner.

Location helps. Many courts and banks still require in-person steps, and out-of-state executors may need to appoint a local agent or post a bond. Speaking of bonds, you can waive the bond requirement in your will to reduce costs—if you trust the person completely.

Consider professional help. Complex estates, businesses, trusts, or blended families often benefit from a corporate fiduciary or an experienced attorney serving as executor (alone or alongside a family member). Professionals charge fees, but delays and disputes typically cost more.

Be practical. Provide your executor with a secure list of key contacts, passwords to a digital vault, and where originals of your will, trust, deeds, and insurance policies are stored. Tell them your wishes for the house and personal items; ambiguity creates friction.

Finally, revisit your choice after major life events—marriage, divorce, births, moves, or a falling-out. The best executor is trustworthy, available, and empowered by a well-drafted, up-to-date plan.
